1. Introduction

Welcome to OurPesa, a fintech platform developed by Acopesa Technologies. OurPesa provides group savings, personal savings, and business investment services. By using OurPesa, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

2. Definitions

  • “OurPesa” refers to the platform and services provided by Acopesa Technologies.
  • “User” refers to any individual or entity using the OurPesa platform.
  • “Services” refers to the financial services offered, including group savings, personal savings, and business investments.
  • “Business” refers to entities seeking capital through OurPesa’s investment platform.

3. Eligibility

To use OurPesa, you must be at least 18 years old and capable of entering into legally binding contracts. By creating an account, you affirm that you meet these requirements.

4. Account Creation

Users must provide accurate and complete information when creating an account. Failure to provide correct details may result in suspension or termination of your account. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.

5. Services Provided

5.1 Group Savings

Users can create or join group savings plans where participants contribute a fixed amount on a regular basis, with funds distributed per a preset schedule.

5.2 Personal Savings

Users can set and manage personal savings goals and schedule automatic deposits.

5.3 Business Investments

Users may invest in listed businesses through OurPesa. OurPesa does not guarantee the success or performance of these investments.

6. Fees

6.1 Transaction Fees

A 1% fee will be applied to all transactions, including deposits, withdrawals, and contributions to savings or investment pools.

6.2 Premium Accounts

Users may opt for premium features, such as higher interest rates, for a monthly subscription fee.

6.3 Investment Management Fee

A 5% commission will be charged on successful business investments facilitated through the platform.

7. User Obligations

  • Compliance with Laws: Users must comply with all applicable laws and regulations, including those related to financial transactions.
  • Prohibited Activities: Users are prohibited from using the platform for illegal activities, fraud, money laundering, or other harmful activities.

8. Security

OurPesa, powered by Acopesa Technologies, uses blockchain technology and other security measures to protect user data and transactions. However, users must take their own precautions to secure their accounts and devices. OurPesa is not liable for unauthorized access resulting from a user’s failure to secure their account.

9. Limitation of Liability

Acopesa Technologies and OurPesa are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of, or the inability to use, the platform. This includes loss of savings or investment returns due to system errors, business failures, or other unforeseen circumstances.

10. Termination of Account

OurPesa reserves the right to suspend or terminate your account at any time for violation of these terms, illegal activity, or other inappropriate behavior. Users may also terminate their accounts at any time by following the app’s account deletion process.

11. Dispute Resolution

Any disputes arising out of or in connection with these terms will be resolved through binding arbitration under the applicable laws of Uganda or the relevant jurisdiction.

12. Modifications to Terms

OurPesa reserves the right to update or modify these terms at any time. Users will be notified of any changes via email or platform notification. Continued use of the platform after the modifications will constitute acceptance of the new terms.
